1. Definitions
Owner/Operator: Rosy Living Houses
Accommodation: Boutique Apartment Rosy No. 1, located in Fuseta, Algarve.
Guest: Any natural person renting the accommodation.
Booking: The agreement between the Guest and the Owner.
2. Legal Registration
The apartment is registered under an Alojamento Local (AL) license, in accordance with Decreto-Lei n.º 128/2014 and subsequent amendments.
The Guest declares that they will comply with all rules arising from this legislation.
3. Booking & Payment
A booking is final once the Guest has received a confirmation and the deposit has been paid.
Deposit: 30% of the total accommodation cost (adjustable).
Remaining payment: 70%, no later than 14 days before arrival. If payment is not made on time, the booking will lapse.
4. Cancellation Policy
Flexible example (adjustable):
Cancellation up to 30 days before arrival: full refund.
Cancellation between 30 and 14 days: 50% refund.
Cancellation within 14 days: no refund.
If, due to external circumstances (such as government measures), rental becomes impossible, the Guest will receive a voucher or a refund in accordance with Portuguese consumer legislation.
5. Check-in & Check-out
Check-in: from 15:00
Check-out: until 11:00
Late check-out is only possible by prior arrangement and may incur additional costs.
Upon arrival, the Guest must present an identification document due to the obligation to register with SEF/Immigration Service (Alojamento de Estrangeiros). This can be done via Lodgify.
6. Maximum Number of Guests
The maximum number of guests is in accordance with the AL permit: 4 persons.
Over-occupancy is not permitted and may result in immediate termination of the stay without refund.
7. Security Deposit & Damage
A security deposit of € … may be required.
The Guest is liable for any damage to the interior, furnishings, inventory, or building caused by negligence or misuse.
Any costs will be deducted from the deposit or charged afterwards.
8. Guest Responsibilities
The Guest undertakes to:
• Leave the apartment tidy and in good condition;
• Not cause nuisance to neighbors (Portuguese noise regulations 22:00–08:00);
• Not engage in illegal activities in the apartment;
• Strictly comply with the house rules (see House Rules).
9. Cleaning & Linen
The rental price includes final cleaning unless stated otherwise.
In case of excessive soiling, additional cleaning costs will be charged.
Interim cleaning upon request is possible for an additional fee.
10. Pets and Smoking
Smoking is not permitted indoors.
Pets are only allowed with prior approval.
11. Safety & Insurance
The accommodation is equipped with:
• Fire extinguisher
• Smoke detector
• First aid kit
• Information about emergency numbers and escape routes
• An emergency exit sign
The Guest is responsible for obtaining their own travel and cancellation insurance.
12. Liability
The Owner is not liable for:
• Loss, theft, or damage to personal belongings;
• Accidents in or around the apartment;
• Disruptions in utilities beyond the Owner’s control (such as water, electricity, internet).
13. Privacy & Data Processing (GDPR)
Personal data is used exclusively for:
• Legal registration (SEF);
• Booking administration;
• Communication with the Guest.
Data is never shared with third parties outside legal requirements.
14. Governing Law
This agreement is governed by Portuguese law.
Disputes should preferably be resolved by mutual consultation. If this is not possible, the Portuguese court shall have jurisdiction.

Eigenaar/Exploitant: Rosy Living Houses
Accommodatie: Boutique Appartement Rosy No. 1, gelegen in Fuseta, Algarve.
Gast: Iedere natuurlijke persoon die de accommodatie huurt.
Boeking: De overeenkomst tussen Gast en Eigenaar.
2. Wettelijke Registratie
Het appartement is geregistreerd onder een Alojamento Local (AL)-licentie, conform Decreto-Lei n.º 128/2014 en latere wijzigingen.
De Gast verklaart zich te houden aan alle regels die voortvloeien uit deze wetgeving.
3. Boeking & Betaling
Een boeking is definitief zodra de Gast een bevestiging heeft ontvangen en de aanbetaling is voldaan.
Aanbetaling: 30% van het totale verblijfskostenbedrag (aanpasbaar).
Restbetaling: 70%, uiterlijk 14 dagen voor aankomst. Bij niet-tijdige betaling vervalt de boeking.
4. Annuleringsbeleid
Flexibel voorbeeld (aanpasbaar):
Annulering tot 30 dagen voor aankomst: volledige terugbetaling.
Annulering tussen 30 en 14 dagen: 50% terugbetaling.
Annulering binnen 14 dagen: geen terugbetaling.
Indien door externe omstandigheden (zoals overheidsmaatregelen) verhuur onmogelijk maken, ontvangt de Gast een voucher of teruggave volgens Portugese consumentenwetgeving.
5. Check-in & Check-out
Check-in: vanaf 15:00
Check-out: tot 11:00
Laat uitchecken is alleen mogelijk in overleg en kan extra kosten met zich meebrengen.
De Gast moet bij aankomst een identificatiedocument tonen vanwege de verplichting tot registratie bij de SEF/Immigratiedienst Alojamento de Estrangeiros. Dit kan via Lodgify
6. Maximum aantal gasten
Het maximum aantal gasten is conform de AL-vergunning: 4 personen.
Overbezetting is niet toegestaan en kan leiden tot onmiddellijke beëindiging van het verblijf zonder restitutie.
7. Borg & Schade
Een borg van € … kan worden gevraagd.
De Gast is aansprakelijk voor alle schade aan interieur, inventaris of gebouw die ontstaat door nalatigheid of misbruik.
Eventuele kosten worden verrekend met de borg of achteraf in rekening gebracht.
8. Verantwoordelijkheden van de Gast
De Gast verbindt zich ertoe:
• Het appartement netjes en in goede staat achter te laten;
• Geen overlast te veroorzaken voor buren (Portugese geluidsnormen 22:00–08:00);
• Geen illegale activiteiten te ontplooien in het appartement;
• Huisregels strikt na te leven (zie Huishoudelijk Reglement).
9. Schoonmaak & Linnen
De huurprijs is inclusief eindschoonmaak tenzij anders vermeld.
Bij excessieve vervuiling worden extra schoonmaakkosten in rekening gebracht.
Tussentijdse schoonmaak op verzoek is mogelijk tegen extra vergoeding.
10. Huisdieren en roken
Roken is binnen niet toegestaan.
Huisdieren zijn alleen toegestaan na voorafgaand akkoord.
11. Veiligheid & Verzekering
De accommodatie beschikt over:
• Brandblusser
• Rookmelder
• EHBO-kit
• Informatie over noodnummers en vluchtwegen
• Een bordje voor de nooduitgang
De Gast is zelf verantwoordelijk voor een reis- en annuleringsverzekering.
12. Aansprakelijkheid
De Eigenaar is niet aansprakelijk voor:
• Verlies, diefstal of schade aan persoonlijke eigendommen;
• Ongevallen in of rondom het appartement;
• Storingen in nutsvoorzieningen buiten schuld van de Eigenaar (zoals water, stroom, internet).
13. Privacy & Gegevensverwerking (GDPR)
Persoonsgegevens worden uitsluitend gebruikt voor:
• Wettelijke registratie (SEF);
• Administratie van de boeking;
• Communicatie met de Gast.
Gegevens worden nooit gedeeld met derden buiten wettelijke vereisten.
14. Toepasselijk recht
Op deze overeenkomst is Portugees recht van toepassing.
Geschillen worden bij voorkeur in onderling overleg opgelost. Indien dit niet mogelijk is, is het Portugese gerecht bevoegd.
